NO PARKING ON TOWNSHIP ROADS - $300 FINE AND TOWING
The Board of Supervisors of Damascus Township, Wayne County, Pennsylvania is authorized by laws of the Commonwealth of Pennsylvania to remove any obstruction in a public road.
The owner of any vehicle, car, truck, trailer, etc. that is parked within a public road right of way during winter months that inhibits or could inhibit the lawful removal of snow and ice by Township employees and/or equipment is subject to a fine of $300.00, towing of the vehicle and criminal prosecution.
Further, if you have acted or allowed an agent to act in a manner that obstructs a public roadway by either placing snow in the roadway or altering a snow bank, or leaving windrows from plowing in the roadway you are in violation of Section 2326 of the Second Class Township Code.
Pursuant to Section 2326 of the Second Class Township Code, any person who obstructs any public road or commits any nuisance thereon by felling trees, making fences, turning the road, diverting water onto or in any other way and who does not, on notice given by the Board of Supervisors, immediately remove the obstruction or nuisance and repair the damages done to the road commits a SUMMARY OFFENSE (Criminal Offense) carrying a fine of up to $300.00. Nothing in this section shall debar a prosecution for any nuisance as in case of misdemeanor at common law.
Any road obstruction could initiate a filing of criminal charges in District Court.
